Incohérence temporelle et théories de l’interprétation constitutionnelle

Abstract

En économie, les constitutions sont le plus souvent présentées comme des outils essentiels de la cohérence des choix politiques dans le temps. Limiter le pouvoir souverain par des règles constitutionnelles permet de lutter contre l’incohérence temporelle du corps politique. L’objet de l’article est de montrer que cette position traditionnelle sous-estime le rôle des interprètes légitimes des constitutions dans le respect des engagements à travers le temps. En effet, dès lors que l’on conçoit l’interprétation comme un acte de volonté et non de connaissance, la question cruciale devient celle de la manière dont les interprètes utilisent leur pouvoir d’interprétation. On montre alors que économie, droit et sciences politique convergent autour des notions clef de légitimité et de crédibilité.
