Omorul savarsit cu premeditare in reglementarea legii penale a Republicii Moldova [The Murder Wittingly Committed in the Penal Legislation of the Republic of Moldavia]

Abstract

An examination of one of the less researched circumstances of the voluntary murder: the murder wittingly committed (lit.a) alin.(2) art.145 PC RM) is undertaken in the present article. At the same time, the identification of the juridical-comparative bases and of the juridicalhistorical bases of the accusatorial disposition concerning the voluntary murder is made. And not the least, the examination of the offence provided by lit.a) alin.(2) art.145 PC RM is performed. In this way, the premeditation constitutive conditions are given to examination: the pass by time from the moment when the murder perpetrating was decided, to the moment of the crime fulfilment; in this amount of time the committer must prepare, he should focus all his psychological intensity, in order to ensure the success of the operation; in this amount of time, the committer must proceed to some preparation deeds, making sure about the good of the idea.
