Magyarország és az Európai Unió Bírósága

Abstract

A szerző, aki az Európai Unió Bíróságának bírája, miután röviden ismerteti a Bíróság szervezetének, hatáskörének alapelemeit, áttekintést ad a Magyarország ellen indított kötelezettségszegési eljárásokról és a magyar bíróságok által kezdeményezett előzetes döntéshozatali eljárásokról. A cikk keretei nem engedik meg valamennyi eljárás ismertetését - a Függelék tartalmazza ezek teljes felsorolását -, ezért a szerző kiemel egyes ügyeket, illetve ügytípusokat, tájékoztatást adva azok megoldásáról is. Hangsúlyozza, hogy Magyarországnak nincs olyan jellegű kapcsolata az Európai Unió Bíróságával, mint országokkal vagy nemzetközi szervezetekkel, de az ügyek számán, tárgyán, az érveken és a meghozott ítéleteken keresztül mindkét oldalon kialakul egy határozatlan kép, amely egyfajta ideiglenes értékelést lehetővé tesz. Ehhez a szerző személyes észrevételeivel is hozzájárul. Journal of Economic Literature (JEL) kód: K33, F15.
