A csőd intézményének rövid története

Abstract

A csőd a világban elterjedt értelemben a fizetésképtelen adós elleni, a vagyona erejéig terjedő általános végrehajtás. E jogi intézmény a piactisztítás fontos eszköze. Magyarországon 1991 előtt a csődöt a reformkortól kezdve törvényileg (a neoabszolutizmus korában rendeletileg) szabályozták. A korabeli csődjog azért nem definiálta külön a magáncsődöt, mert az a csőd alapesete volt. A régi csődjog az államosításokkal kiürült. Az 1991. évi csődtörvény fogalmilag elhagyta a nemzetközi és az azzal összhangban volt hazai történeti értelmezést. Journal of Economics Literature (JEL) kód: N43, N44.
