İşçilerle İlgili Sosyal Sigorta Mevzuatının Gelişimi: “Yap-Boz-Yap” Döngüsünden Çıkılabilir mi?

Abstract

Türk sosyal sigorta sistemi, sık yapılan müdahalelerle sosyal sigorta haklarını ve yükümlülüklerini düzenleyen mevzuat bakımından adeta “yap-boz-yap” döngüsüne girmiştir. Geçmişte 506 sayılı Sosyal Sigortalar Kanunu ve 5434 Sayılı T.C. Emekli Sandığı Kanunu dağınık sosyal sigorta mevzuatını toplamayı amaçlayan “tek çatı” kanunları olarak yürürlüğe girmişti. 5510 sayılı Kanun da aynı gerekçelerle hazırlanmış ve yürürlüğe konulmuş bir “tek çatı” kanunudur. Ancak Kanunun yürürlük tarihinden bugüne (Eylül 2022) kadar geçen 16 yıllık sürede 80 ayrı müdahale ile değişiklikler yapılmıştır. Adeta tarih bir kez daha tekerrür etmekte ve önceki dönemlerde olduğu gibi 5510 sayılı Kanunda da yeniden “sadeleştirme” amaçlı kapsamlı düzenleme yapma ihtiyacı doğmaya başlamıştır. Kısacası, Türk sosyal sigorta sistemi yine “düzenle-boz-yeniden düzenle döngüsüne” doğru hızla yol almaktadır. Bu çalışmada bu döngüyü yaratan gelişmeler, sosyal sigorta mevzuatı ile ilgili “nitel” değişimler esas alınarak incelenmektedir. Bu inceleme ile sosyal sigorta mevzuatında sık yapılan değişikliklerle ortaya çıkan “yap-boz-yap kısır döngüsünün” sosyal sigorta hak ve yükümlülükler dengesine yönelik olumsuz etkilerine dikkat çekilmeye çalışılmaktadır.
