Le procedure negoziate e l?esclusione automatica delle offerte anomale, ? davvero una accelerazione e una semplificazione del sistema?

Abstract

Il nuovo Codice dei contratti pubblici (D.Lgs. 36/2023) rende definitivo il regime emergenziale dell?affidamento dei contratti pubblici sotto soglia, con vistose limi- tazioni alla concorrenza. Da una disamina che muove da dati certi, emerge che la lunghezza dell?affidamento e della esecuzione dei contratti pubblici in Italia non dipende dalla durata delle gare, n? dal contenzioso in materia, bens? da lentezze nel passaggio da una fase all?altra, soprattutto nella progettazione. In tal quadro, il Codice sacrifica la concorrenza per perseguire una celerit? procedimentale negli affidamenti che non rappresenta un reale fattore; con possibili scompensi di si- stema, anche in termini di (dis-)incentivi agli investimenti.
