Le concessioni demaniali marittime tra promozione della concorrenza e mantenimento dello status quo: verso la fine di una storia infinita?

Abstract

Il contributo prende in esame le concessioni demaniali marittime e, nello specifico, il trasferimento del rischio e la loro durata alla luce della Direttiva cd. Bolkestein e della sentenza della CGUE del 14.7.2016. L?intervento dell?Adunanza Plenaria del Consiglio di Stato, con le sentenze nn. 17 e 18 del 2021, pare, poi, aver posto fine all?abuso della proroga delle concessioni. Nelle conclusioni si dar? conto del nuovo DDL Concorrenza, il quale potrebbe introdurre una disciplina uniforme delle concessioni demaniali marittime.
