La funzione sociale delle successioni mortis causa nella disciplina costituzionale

Abstract

La Costituzione qualifica se stessa come la Legge fondamentale della Repubblica e, in quanto tale, identifica le norme fondamentali dell?ordinamento repubblicano. Anche gli istituti di diritto privato rinvengono il proprio fondamento nella Carta costituzionale: nell?ultimo comma dell?art. 42 Cost., infatti, il Costituente rivolge l?attenzione alla successione mortis causa, di cui il presente lavoro mira ad indagare la funzione sociale.
