La disciplina europea sulle indicazioni nutrizionali e sulla salute: dieci anni di applicazione controversa

Abstract

L?articolo analizza i principali problemi interpretativi e applicativi del reg. (CE) n. 1924/2006 sulle indicazioni nutrizionali e sulla salute fornite sugli alimenti. In particolare, dopo avere brevemente descritto quali indicazioni sono consentite sul mercato europeo, l?autore mette in evidenza i profili critici emersi nell?iter legisla-tivo e le soluzioni di compromesso adottate con riferimento ai marchi interpretabili come indicazioni nutrizionali e sulla salute e ai descrittori cosiddetti generici, non-ch? con riferimento alle indicazioni funzionali sulla salute non inserite nell?appo-sito elenco dell?Unione. Si sofferma, poi, sulle specifiche questioni attualmente oggetto di valutazione da parte della Commissione europea, cio? l?applicazione eccessivamente rigorosa della norma sulla fondatezza scientifica delle indicazioni funzionali sulla salute e l?utilit? della definizione di profili nutrizionali specifici a dieci anni dall?entrata in vigore del regolamento.
