L?indicazione facoltativa di qualit? "prodotto di montagna"

Abstract

Una delle principali novit? introdotte dal reg. (UE) n. 1152/2012 sui regimi di qualit? ? la disciplina delle ?indicazioni facoltative di qualit??. Dopo averla brevemente esaminata, evidenziandone il contesto politico in cui ? maturata, nonch? l?ambito di applicazione, l?Autore si sofferma sulla prima e, per ora, unica indicazione facoltativa di qualit? "istituita" dal regolamento: "prodotto di montagna". Di essa vengono esaminare, in particolare, le condizioni d?uso, anche alla luce del regolamento delegato della Commissione europea n. 645/2014. Partendo, poi, dai dubbi interpretativi che sorgono dalla lettura dell?art. 28 del reg. (UE) n. 1151/2012, sulle disposizioni nazionali che possano essere "mantenute" in vigore, l?Autore affronta la questione dell?illegittimit? o meno delle indicazioni di provenienza montana del prodotto disciplinate dal legislatore italiano ai sensi del d.lgs. n. 228/2001 e della "legge finanziaria 2003".
