Abstract

La relazione analizza le vicende storiche riguardanti l?introduzione delle nozioni di impresa commerciale ed impresa agricola nella codificazione del 1942 e della legge fallimentare destinata alla sola impresa commerciale a seguito della scomparsa del codice di commercio. I recenti interventi legislativi hanno posto le basi per il superamento dell?assetto disciplinare accolto nella codificazione del 1942 sia in conseguenza dell?effettivo sviluppo dell?impresa agricola intervenuto negli ultimi decenni, sia per il radicale mutamento di funzione della legge fallimentare. Sullo sfondo, resta, per? da rivedere la distinzione dimensionale delle imprese
