Abstract

En materia penal, la prueba ilícita es aquella que vulnera los derechos fundamentales del acusado. La presente investigación describe en qué consiste la prueba ilícita, hace referencia a las reglas de exclusión de la misma y procede a analizar algunos tipos de diligencias probatorias ilícitas: como la intervención de las comunicaciones privadas, la tortura en la obtención de confesiones y la autoincriminación. Asimismo, se hace referencia a la resolución de los tribunales en algunos países en los que se regula prueba ilícita.
