La Patentabilidad De La Materia Viva En El Derecho Comunitario Europeo

Abstract

A través de la historia de la humanidad el hombre ha manipulado a los seres vivos de una manera consciente o inconsciente buscando un beneficio propio. Los ejemplos múltiples. La domesticación de los animales, su cruza en busca de nuevas variedades, la producción de vino, cerveza, queso y yogur son producto de la biotecnología, aunque el hombre no haya reconocido este término sino hasta hace poco tiempo. Esta alteración de la vida, producida tradicionalmente por el hombre, se ha hecho sin tocar la esencia de la conformación de los seres vivos, su parte genética, es decir sin manipulación genética, ha sido una transformación de carácter sexual.
