Biobancos E Investigacion Biomedica. Algunas Reflexiones A La Luz De La Normativa Española

Abstract

Este artículo analiza los retos y dilemas introducidos en el campo de la investigación biomédica en referencia al ejercicio de los derechos de los pacientes y la definición jurídica del régimen aplicado a los biobancos. Cuestión que si bien se aproxima desde el derecho comparado incorpora las últimas referencias normativas introducidas en la Ley Española de investigación biomédica y en el recién aprobado Decreto de Registro de biobancos de la Comunidad Autónoma Andaluza. Este artículo describe los principales contenidos de la disposición andaluza, con la finalidad de incorporar elementos de reflexión sobre los nuevos escenario de intervención pública y sus limites en la configuración de los derechos derivados de la aplicación de la normativa sobre patentes, como instrumento para la salvaguarda de las innovaciones tecnológicas derivadas de la investigación biomédica.
