El Derecho conculcado del alumno a una evaluación objetiva en la LOMCE

Abstract

Este artículo presenta un análisis del sistema de evaluación arbitrado en la Ley Orgánica de Mejora de la Calidad Educativa (LOMCE, 2013) desde una perspectiva crítica con base en aspectos técnicos y didácticos del desarrollo normativo. El desarrollo de la evaluación en la actual ley educativa se afronta desde un sistema complejo de criterios y estándares de aprendizaje evaluables que sirven de referencia para la evaluación de contenidos y competencias del currículo. Este sistema ha adoptado un alto grado de complejidad técnica que posiciona al docente ante la “casi” imposibilidad de cumplirlo tal y como viene expresado en la normativa al efecto (Orden ECD/65/2015). En un sistema de evaluación mundial (PISA, PRILS, TIMSS, etc.) cada vez más preocupado por una evaluación más cualitativa y competencial, el nuevo sistema propuesto parece chocar de frente con las corrientes pedagógicas actuales además de que su gran complejidad puede conculcar el derecho del alumno a una evaluación objetiva.
