Abstract

El trabajo aborda el análisis de la pieza teatral de Jovellanos titulada 'El delincuente honrado'. Esta obra presenta un carácter literario experimental e innovador en España como primer ejemplo de lo conocido como 'comedia lacrimosa'. Ese mismo rasgo de novedad está presente en el tratamiento del asunto jurídico sirve a la acción dramática, produciendo una temprana implicación de Derecho y Literatura. De ese modo, Jovellanos utiliza recursos de teatralidad y escenografía para mostrar un debate entre dos modelos de magistrados que a su vez representan dos paradigmas jurídicos opuestos pero sincrónicos durante el último tercio del siglo XVIII; Derecho antiguo v. Derecho ilustrado. Se examina el universo de libros jurídicos con los que en la escenografía respectivamente se identifican las condiciones ideológicas del conflicto normativo, judicial y dogmático-jurídico.
