El Principio De Autonomía De La Voluntad Contractual Civil. Sus Límites Y Limitaciones

Abstract

La autonomía de la voluntad es un principio básico del Derecho contractual. El valor de este principio se aprecia en el hecho de considerarse como una manifestación de la libertad del individuo, cuyo reconocimiento por la ley positiva se impone, el cual se traduce en la posibilidad que tienen las personas de regular libremente sus intereses, ejercitar los derechos subjetivos de los cuales son titulares y concertar negocios jurídicos.Sin embargo, independientemente de ser considerada como uno de los principios más importantes en el Derecho Civil y específicamente en el Derecho de Contratos, no es admitida de forma absoluta, por cuanto tiene restricciones previstas en la ley y otras que se desprenden de las circunstancias o de las situaciones de hecho. Dichas restricciones se manifiestan en forma de límites y limitaciones.
