Desarrollo Y Evaluación De Competencias Retóricas Orales Y Escritas Por Medio De Ensayos Y Casos Prácticos

Abstract

Con frecuencia, la utilización de casos prácticos en nuestras facultades de Derecho se centra en el acierto técnico de la solución. En nuestro sistema jurídico se insiste especialmente en el aprendizaje de conceptos y de relaciones lógicas entre los mismos dado que el Derecho se entiende como una construcción científica y legislativa coherente y sistemática. Por contraste, en el ámbito anglosajón el derecho se construye en mucha mayor medida por medio de la labor creadora de la jurisprudencia y la enseñanza insiste mucho más en que los alumnos aprendan a argumentar retóricamente sobre cualquier problema. El objetivo del trabajo es mostrar un método específico de desarrollar y evaluar estas competencias retóricas por medio de la elaboración de ensayos escritos y de su defensa oral ante colegas y profesores.
