Alcance jurídico de la cooperación eficaz en los delitos contra la eficiencia de la administración pública

Abstract

El presente artículo científico tiene como objetivo demostrar, que la Cooperación Eficaz, ecuatoriana carece en su normativa penal premial, de un procedimiento claro, especifico y proporcional al momento de otorgar un beneficio, esto lo encontramos en la sección Tercera de las Técnicas Especiales de Investigación, del Código Orgánico Integral Penal, dejando en impunidad los delito de la Eficiencia de la Administración Pública, es por esto que estamos proponiendo que se realice una reforma jurídica al Art. 492 Código Orgánico Integral Penal, respecto a los requisitos y trámites formales sobre todo cuando están inmersos Funcionarios Públicos, que están cometiendo delitos propios y especiales por su naturaleza.
