La falta de motivación del laudo arbitral afecta su validez, provocando nulidad

Abstract

En Ecuador el arbitraje como método alternativo de solución de conflictos se ha convertido en un sistema muy utilizado por los ciudadanos para resolver problemas jurídicos por sus características propias. El Tribunal de arbitraje expide un laudo arbitral que contiene la decisión adoptada sobre el caso concreto. Según la Ley de Arbitraje y Mediación, el único mecanismo de impugnación del laudo arbitral es la acción de nulidad contemplada en el artículo 31 del cuerpo normativo antes mencionado, que contiene cinco causales por las cuales se podría ejercer la acción.
