Implicaciones de la exclusividad de las patentes farmacéuticas: el derecho de acceso a los medicamentos en la encrucijada

Abstract

A través del presente artículo se propone un escenario crítico a la exclusividad de las invenciones farmacéuticas otorgada por las patentes. Se delimita un escenario reflexivo sobre el rol de la industria farmacéutica innovadora, de la propiedad intelectual y de los Estados. Utilizando un enfoque metodológico inductivo apoyado en el estudio doctrinal y el análisis de normatividad nacional e internacional vigente, se esbozan algunas reflexiones respecto a las implicaciones de dicha exclusividad y teniendo en cuenta la necesidad de redimensionar el acceso a los medicamentos como derecho desde el sistema de patentes.
