Derechos privados y potestades públicas en el ámbito de los cementerios cubanos. Una mirada desde la reforma constitucional actual

Abstract

El artículo se propone analizar los preceptos implementados en la nueva Carta Magna, trascendentes al régimen de los cementerios públicos. En su metodología se utilizaron los métodos: histórico–lógico, que enfocó el tratamiento jurídico de los cementerios públicos en Cuba y el inductivo-deductivo, que ilustró los fenómenos jurídicos trascendentes a los derechos privados y potestades públicas en el ámbito de los cementerios, consagrados en la nueva Constitución. Como resultado se ofrece un diagnóstico de la precaria regulación cementerial cubana y la necesidad de una ley de cementerios.
