Presupuestos doctrinales para distinguir la estafa penal y el fraude civil en el ordenamiento jurídico cubano

Abstract

La presente investigación pretende establecer desde una perspectiva, histórico, doctrinal y exegética, presupuestos teóricos para la adecuada configuración normativa, interpretación y aplicación por los órganos jurisdiccionales de la estafa penal y el fraude civil en Cuba, contribuyendo así a una correcta distinción entre ambas instituciones y se eliminaría con ello la contradicción existente entre los operadores del Derecho y la praxis judicial cubana. Para alcanzar los objetivos propuestos se emplearon métodos teóricos generales de las ciencias: histórico, análisis-síntesis, inducción-deducción; métodos específicos de las investigaciones jurídicas de orientación teórica: teórico-jurídico, jurídico-comparativo, exegético y el método empírico: análisis de contenido.
