Abstract

En el presente trabajo se aborda la problemática de las Medidas cautelares en el proceso civil ecuatoriano, donde se estudiará el Código de Procedimiento Civil, y el Código Orgánico General de Proceso; realizando un análisis crítico de dichas instituciones, tanto sus fundamentos teóricos, doctrinales como jurisprudenciales, a los efectos de poner de manifiesto las imperfecciones de que adolece el actual sistema procesal civil y realizar algunas conclusiones en función de su perfeccionamiento.
