A prevalência do negociado sobre o legislado na reforma trabalhista: análise dos artigos 611-A E 611-B

Abstract

O presente artigo trata sobre a prevalência do negociado sobre o legislado e da possibilidade, concedida pela Constituição Federal, de que aspectos acordados em negociações coletivas trabalhistas possam prevalecer sobre lei expressa. Tal conteúdo não é matéria recente no ordenamento jurídico brasileiro, porém, os limites para sua aplicabilidade e utilização ainda são motivos de debate na doutrina e jurisprudência nacional. Com a Reforma Trabalhista - Lei 13.467/17 – foram acrescentados na CLT os artigos 611-A e 611-B, que discursam sobre o tema de forma a aumentar o campo de atuação da autonomia privada coletiva, possibilitando que normas autônomas coletivas prejudiciais ao trabalhador se sobreponham sobre normas heterônomas imperativas. Desta forma, o objetivo da presente pesquisa é analisar os novos limites da prevalência do negociado sobre o legislado, identificando se afrontam normas basilares do direito brasileiro, de modo a identificar se os dispositivos 611-A e 611-B apresentam harmonia com o ordenamento em que se inserem.
