La huelga en los servicios públicos esenciales en Colombia y en el mundo “¿es ilegal?â€

Abstract

Durante el año 2018, en el estado colombiano, se presentaron huelgas a nivel de los servicios públicos esenciales, por ejemplo, en la recolección de basuras por los trabajadores de la empresa de aguas Bogotá S.A., o en el servicio público de transporte de AVIANCA S.A. Con fundamento en dichos hechos, el presente artículo pretende resolver las siguientes preguntas: ¿Qué son los servicios públicos? ¿Cuál es el origen de los servicios públicos? ¿Cómo se clasifican los servicios públicos? ¿Cuáles son los servicios públicos esenciales en Colombia? ¿Cuál es la normativa interna en Colombia sobre los servicios públicos? ¿Qué se entiende por huelga? ¿Cuáles son los convenios que adopta Colombia frente a la huelga? ¿La huelga en los servicios públicos en Colombia es legal? ¿Cuáles son las etapas de la huelga? Para ello se realizará un recorrido por la evolución histórica del concepto de huelga y los servicios públicos esenciales en Colombia comparando el derecho francés norteamericano, Perú, Costa Rica para determinar finalmente cuales serían las consecuencias sociales y jurídicas de la huelga en Colombia.
