Derechos constitucionales ambientales, protección constitucional y ordenamiento jurídico cubano

Abstract

Sobre la regulación jurídica de los derechos constitucionales ambientales existen escasos estudios teóricos, lo que explica su limitada aplicación práctica y la no remisión de los autores cubanos desde el punto de vista constitucional a ellos. En la presente investigación se realiza un estudio doctrinal, comparado y sobre su regulación jurídica, haciendo especial referencia al tratamiento brindado por el Ordenamiento jurídico cubano, principalmente por la Constitución de la República de 2019. Se parte de la necesidad de que se contemple una regulación legal adecuada de dichos derechos. Por ello es que el objetivo principal se centra en valorar la regulación legal que brinda el Ordenamiento jurídico cubano a los derechos constitucionales ambientales. El resultado de la investigación al perfeccionamiento de la doctrina y del Ordenamiento jurídico cubano en materia de derechos constitucionales ambientales, en aras de asistir al desarrollo jurídico y ambiental de nuestro país.
