A efetividade dos direitos sociais no Brasil, frente ao pacto internacional sobre direitos econômicos, sociais e culturais

Abstract

Fruto de intensos movimentos reivindicatórios desde o estabelecimento da ordem econômica contemporânea derivada da Revolução Francesa e Industrial, os Direitos Sociais são o substrato legal que aceiram o fiel da balança do direito. O Brasil possui vasto rol de Direitos Sociais na Carta Magna, pautado pelo Princípio da Dignidade da Pessoa Humana e é signatário do Pacto Internacional Sobre Direitos Econômicos, Sociais e Culturais. Frente ao Pacto Internacional Sobre Direitos Econômicos Sociais e Culturais, os direitos sociais são efetivos no Brasil? A resposta é negativa. O Brasil desponta como um dos países mais desiguais do mundo. Estudos de Thomas Piketty colocam o Brasil no topo do ranking de desigualdade econômica/social quando analisado o percentual de riquezas nas mãos do 1% mais rico, o país apresenta 27,8%! O país carece de medidas de correção dessa anomalia econômica e a tendência é que o país ultrapasse os 30% até final de 2019.
