Estudio jurídico sobre la aplicación del acuerdo ministerial MDT-2017-0135, referente a las sanciones de los empleadores públicos y privados por incumplimiento

Abstract

La sanción establecida en el instructivo que crea para los empleadores la obligación de declarar datos de los trabajadores por medio de una plataforma virtual creada por el gobierno, carece de legalidad según los artículos 192 y 194 del ERJAFE y por lo tanto no podría ser aplicable por parte del Ministerio de Trabajo sin embargo se sigue sancionando a los empleadores en base a esta normativa, que a pesar de ser de menor rango e ir en contra de este decreto se sigue aplicando dentro de nuestro acontecer jurídico actual. Dentro de este estudio se analiza varias posibilidades por las cuales no podría ser aplicable este acuerdo entre estas también se analiza el hecho de que para aplicar sanciones del Código de Trabajo estas deben estar dentro del Código de manera expresa ya que los artículos que sanciones las infracciones al Código no se prestan para interpretaciones, esto en caso de que se considere que esta normativa del instructivo sirve para lograr que se cumple lo que establece el Código, sobre esto se hace un análisis sobre jurisprudencia de Corte Nacional en casos sobre los cuales se ha sancionado con instructivos emitidos por el ejecutivo en otras materias del derecho en nuestro país.
