La superficie y la edificación de viviendas en Cuba y las sucesivas modificaciones legislativas

Abstract

En Cuba la cuestión de la vivienda de ocupación permanente ha pasado por varias etapas, muchas de ellas signadas por regulaciones insólitas que han vulnerado el principio de autonomía de la voluntad, como la prohibición de las personas disponer libremente de los inmuebles desde los años 60 hasta las modificaciones a la Ley General de la Vivienda en el año 2011. Ante la necesidad habitacional, una gran mayoría de personas se dispusieron a construir su propia casa, enrolándose entonces en la búsqueda de terrenos para edificar, lo que conlleva la realización de innumerables trámites para adquirir un Derecho Perpetuo de Superficie (DPS) u otro espacio donde edificar, lograr la correspondiente Licencia de Construcción y Certificado de habitabilidad, entre otra documentación reglamentada, para finalmente obtener un título dominico administrativo o notarial.
