La Escucha Del Niã‘O En Cuba. Nuevos Retos Para La Justicia De Familia

Abstract

Este trabajo aborda sobre las particularidades, desde el punto de vista procesal, que sostienen a la escucha de las niñas, niños y adolescentes en los procesos judiciales que le afectan. La nueva jurisdicción de familia ha reflejado innumerables logros en este campo del Derecho, sin embargo, a casi a tres años de aplicación, se perciben incongruencias procesales que limitan de algún modo el derecho de participación del niño en estos procesos directamente, quedando un poco desprovistos de la adecuada protección al interés superior enunciado internacionalmente, lo cual trae a reflexión algunos aspectos que se pudieran considerar en tales procederes.
