Derecho De Acceso A La Energã A. Protecciã“N Constitucional En Cuba

Abstract

La energía es fundamental para el desenvolvimiento de nuestra vida y para el desarrollo de la capacidad de producción. Sin embargo, existe un número de personas en el mundo que viven sin esta. En la medida que aumenten las necesidades de energía para el uso doméstico, industrial y agrícola, se hace cada día más indispensable la necesidad del reconocimiento al acceso a esta como un derecho humano o fundamental, por lo que en este trabajo se precisan algunas cuestiones respecto a ambas denominaciones, siendo imprescindible considerar el surgimiento y el evolucionar de estos. También se realiza un análisis de la protección internacional que recibe el derecho al acceso a los servicios energéticos, a través de un gran número de iniciativas que propician su salvaguardia y su reconocimiento en varios instrumentos jurídicos, tales como Declaraciones, Pactos y Convenciones. Finalmente se analiza la protección que brinda la Constitución cubana.
