Abstract

Este artigo trata sobre a justiça de transição, que é o mecanismo utilizado quando da passagem de um regime ditatorial para o (re)estabelecimento da democracia. Aborda a influência de posicionamentos filosóficos para a aplicação tentar resolver a pergunta sobre o que seria a coisa certa a ser feita. Fazer a justiça de transição implicaria em estabelecer arranjos sociais instáveis com possível punição para os violadores de direitos humanos. Não fazê-la significaria relegar ao esquecimento desrespeitos a direitos humanos universalmente consagrados. Trata também do constitucionalismo de transição e sua importância para a criação de uma constituição transitória possível para a concretude do Estado Democrático de Direito. Pretende demonstrar a necessária correlação entre esses termos para a obtenção de justiça e paz após regimes de exceção. Nesse sentido, será feita a exposição dos conceitos e características dos dois fenômenos.
