Sobre La Nociã“N De Validez Del Derecho

Abstract

El presente artículo, titulado: “Sobre la noción de validez del Derecho…†, aborda una polémica que no ha dejado de tener vaivenes entre los profesionales del Derecho y, muy especialmente, entre aquellos que se dedican a la noble labor de enseñar Filosofía y Teoría en nuestras Facultades de Derecho. De tal suerte que el principal objetivo de este artículo sea realizar un análisis teórico-doctrinal acerca de la noción de validez y cómo esta se relaciona con la eficacia. Así entonces, se muestran las diferentes concepciones teóricas que en torno a la noción de validez han sido esgrimidas, sus representantes y posibles fundamentos, lo cual dota a este artículo de una sólida y vasta base doctrinal. Por su parte, se realiza un profundo estudio iusfilosófico en pos de establecer las relaciones que existen entre la validez y la eficacia desde la perspectiva de la norma jurídica y el Ordenamiento Jurídico.
