Abstract

Así las cosas, los constituyentes, al incorporar el Art. 41 se manifestaron respecto de las competencias que, en materia ambiental, le corresponde a cada jurisdicción. En el tercer párrafo del artículo citado y según las palabras de los constituyentes, “...Corresponde a la Nación dictar las normas que contengan los presupuestos mínimos de protección, y a las provincias, las necesarias para complementarlas, sin que aquéllas alteren las jurisdicciones locales...”
