Abstract

O presente artigo tem por objetivo analisar a possibilidade ou não de efeito de confisco na atuação do auditor fiscal frente ao conceito de legalidade, posicionando-se acerca do assunto. Busca compreender os institutos relacionados, elucidando conceitos e manifestando-se a favor da legalidade da correta atuação legislativa, da representatividade e do poder do povo, tendo como uma de suas consequências o impacto na delimitação da atuação do Poder Executivo. Para atingir esse objetivo, faz-se a análise teórica dos elementos à luz da legislação e dos referenciais teóricos, caracterizando-se o estudo como descritivo e analítico, de abordagem qualitativa, com apoio bibliográfico e documental.
