La Prestación Y El Cobro Del Servicio De Alumbrado Público, Desde Una Perspectiva Jurídica Y Económica

Abstract

El servicio está a cargo de los entes territoriales, quienes lo prestan directa o indirectamente. Desde el año 1915, en virtud de la ley 84, los concejos municipales quedaron facultados para la creación de un impuesto que buscara la forma de asumir los costos correspondientes a la financiación del alumbrado público, lo cual le ha permitido a algunos municipios, destinar los recursos necesarios para los gastos de inversión social. No obstante, la complejidad que envuelve la prestación del servicio y la incertidumbre jurídica en materia de financiación, resaltan la pertinencia de generar una política pública que fortalezca el contexto jurídico, la capacidad administrativa de los prestadores y la generación de espacios para la participación activa de la comunidad.
