Participação exclusiva em licitações de microempresas e empresas de pequeno porte sediadas no âmbito local: conflito de princípios

Abstract

Este trabalho tem como objetivo analisar a possibilidade ou não da Administração Pública lançar edital para participação exclusiva em licitações de Microempresas e Empresas de Pequeno Porte sediadas no âmbito local, atitude que recentemente tem sido observada em alguns Municípios, inclusive no estado de Santa Catarina e que pode causar conflito entre o Estatuto Nacional da Microempresa e da Empresa de Pequeno e os princípios que regem as licitações públicas.
