A proibição dos canudos plásticos e a (IN) eficiência econômica

Abstract

O estudo tem como objetivo analisar os efeitos econômicos das leis que proibiram o uso de canudos plásticos no Brasil e os seus possíveis efeitos. A preocupação com o meio ambiente e as demandas por alternativas sustentáveis mostram-se relevantes do ponto de vista ecológico e social, no entanto, a partir de uma Análise Econômica do Direito e aplicando conhecimentos da Economia Comportamental, é possível fazer uma análise crítica da proposta legislativa que, embora baseada em boas intenções, pode não garantir bons resultados. O estudo pretende demonstrar também a incidência do Efeito Peltzman na proposta legislativa que resultou em efeitos antagônicos com relação ao animus do legislador.
