A prova testemunhal no procedimento acusatório

Abstract

La prueba testimonial fue vista a lo largo de la historia como un medio de prueba cuestionable. Se desconfiaba de los testigos en sí, así como del contenido de sus testimonios y aún, de la forma de producción de tal prueba. Aún hoy, la prueba testimonial es vista por algunos con cierta desconfianza, siendo bastante criticada. Sin embargo, teniendo en cuenta la importancia de este medio de prueba, considerada uno de los más, sino el más utilizado dentro del proceso penal brasileño, se busca comprender la prueba testimonial de forma más profunda. De esta forma, el presente artículo tiene por objetivo hacer un análisis de la prueba testimonial a través del estudio integrado de la legislación actual y del contexto histórico. De esta forma, se busca analizar el sistema de pruebas al día, definiendo tal medio de prueba y delimitando sus características. Además, se busca identificar sus ventajas y desventajas, así como comparar su uso e interpretación en el pasado con su aplicación en los días actuales.
