Judicialização de políticas públicas e sociais

Abstract

Quando ocorre a violação de direitos a população, geralmente, busca uma solução através da chamada judicialização, ocorrendo o afogamento do poder judiciário. A implementação de Políticas Públicas adequadas, poderá ajudar estas pessoas na efetivação de seus direitos, sem haver a necessidade de ingresso com ações judiciais. Para tanto, faz-se necessária a atuação de outros profissionais, como por exemplo, os assistentes sociais, para que identifiquem as carências daquela população referente à serviços básicos resguardados pela Constituição Federal. Trataremos de três pontos básicos, começando pela conceituação de Políticas Públicas, adentrando na questão da judicialização como forma de acesso à justiça, e, então, a questão da judicialização de políticas públicas e sociais.
