Jus postulandi na justiça do trabalho: possibilidade ainda viável

Abstract

O presente apresenta o jus postulandi no âmbito da Justiça do Trabalho. Define-se esse instituto e em que consiste a técnica de especialização procedimental, que confere à parte a capacidade de postular diretamente em juízo, sem a obrigatoriedade da presença de advogado. Analisa-se a Súmula 425 do TST, a respeito do ensaio para o fim do jus postulandi, a mitigação deste Principio no processo do trabalho. A ineficácia do jus postulandi sob a concepção do efetivo acesso à justiça, apresentando os fundamentos que embasam este relevante instituto. Além de estabelecer o conceito, características e procedimentos jurídicos a respeito do referido instituto, demonstrando os benefícios inerentes e os possíveis perigos deste instituto, o artigo baseia-se em princípios legais, texto expresso de lei, citações doutrinárias e referencias jurisprudencial a respeito do tema.
