Menor vulnerável!? considerações acerca do estupro de vulnerável

Abstract

O presente trabalho objetiva analisar o crime do estupro de vulnerável pela perspectiva da presunção de vulnerabilidade dos menores de catorze anos, para tanto, será apresentado um histórico do delito desde a Antiguidade até a atualidade, bem como sua análise esquemática. Adiante passa-se ao exame da violência como figura essencial para a caracterização do crime e sua desnecessidade, quando se tratar de vítima vulnerável. Por fim, a partir da apreciação conjunta de normas, jurisprudência e doutrina busca-se descobrir se existe possibilidade de excluir a tipicidade da ação, afastando a conduta do indivíduo.
