Abstract

O presente trabalho busca analisar a estrutura das normas de proteção ao trabalhador dentro de um sistema constitucional de proteção aos Direitos Sociais do Trabalho, para então refletir quanto à responsabilidade pelo adimplemento dos direitos trabalhistas, buscando refletir quanto aos mecanismos existentes no Direito nacional que permitem a redução do custo despendido na contratação de mão de obra, e quais os riscos que a adoção destes mecanismos podem causar ao patrimônio pessoal do tomador dos serviços.
