Justiã‡A Restaurativa: Uma Alternativa À Efetivaã‡Ãƒo Do Princã Pio Do Acesso À Justiã‡A

Abstract

O direito fundamental de acesso à justiça previsto na Constituição Federal de 1988 é tradicionalmente exercido através do Poder Judiciário. Contudo, diversos fatores de naturezas heterogêneas, associados ao paradigma processual racionalista-individualista utilizado têm obstado a efetivação deste direito constitucional, impedindo a realização da justiça e a pacificação social. Nesse panorama a Justiça Restaurativa surge como um importante instrumento de resolução alternativa dos conflitos capaz de concretizar o direito ao acesso à justiça, resgatando também a noção de justiça como valor na comunidade.
