La Libertad Contractual Y La Aplicaciã“N De La Ley En El Tiempo

Abstract

La Constitución Política Peruana de 1993 consagra la libertad contractual en su artículo 62º, como garantía para que las partes pacten válidamente según las normas vigentes al tiempo del contrato, sin que el Estado modifique su acuerdo por leyes u otros dispositivos. Asimismo, el artículo 1354º del Código Civil contempla este derecho. Sin embargo, su noble fin de brindar seguridad a los contratantes, se desvirtúa ante la contradicción entre estos artículos y el artículo 103º de la Constitución, que señala “... La ley, desde su entrada en vigencia, se aplica a las consecuencias de las relaciones y situaciones jurídicas existentes y no tiene fuerza ni efectos retroactivos…†Frente a tal discordancia, nos preguntamos: ¿Qué sucedería si las normas supletorias que regulan la relación jurídica emanada del contrato, son modificadas por el legislador? La búsqueda de una respuesta motiva a reflexionar sobre la relación entre la libertad contractual la aplicación de la ley en el tiempo.
