Apontamentos Sobre A Incidãšncia Dos Direitos Fundamentais Nas Relaã‡Ã•Es Privadas

Abstract

O presente estudo tem por finalidade tecer considerações gerais sobre o adequado entendimento segundo o qual os direitos fundamentais possuem eficácia direta e imediata nas relações privadas. Através do método dedutivo, iniciar-se-á a discussão a partir da concepção de direitos humanos, especificando-se a derivação dos direitos fundamentais e a consequente irradiação de seus efeitos às relações entre o particular e o Estado e notadamente nas relações privadas, para em fecho comprovadamente constatar a perfeita adequação e efetivação dos direitos fundamentais nas relações entre particulares.
