Abstract

Na busca de soluções para o crescimento da criminalidade, transforma-se o principio da ultima ratio do direito penal em prima ratio. Cria-se o fenômeno da expansão do direito penal e novos institutos são criados. Institutos que separam inimigos de cidadãos, diminuindo as garantias processuais e implementa-se um paradigma da segurança cidadã, no intuito de transparecer para a sociedade que existe segurança. Tais institutos e paradigmas geram resultados? O presente trabalho busca responder este questionamento apresentando Justiça Restaurativa como uma possibilidade na reabilitação do delinquente.
