Neoconstitucionalismo e a judicialização da política no Brasil

Abstract

O presente trabalho versa sobre a influência do neoconstitucionalismo para que determinados temas, antes considerados eminentemente políticos, sejam decididos por juízes e tribunais, ensejando o processo conhecido como judicialização da política no Brasil. A pesquisa tem como objetivo principal identificar a existência de uma relação entre o neoconstitucionalismo e o fenômeno da judicialização da política no país. Busca definir o que é neoconstitucionalismo e suas características principais, analisa o surgimento da fase contemporânea do constitucionalismo, a ascensão da jurisdição constitucional nessa fase e a sua relação com a judicialização da política no Brasil.
