Comentarios sobre las competencias en materia ambiental

Abstract

After some considerations on the deterioration of the environment which has been taking place during the last decades and some details concerning Environmental Law, seen and analysed from the legal point of View, this article deals with the questions of authority which exist between the different levels of Public Administration: State, Autonomous, Provincial and Local, for which it is necessary to base oneself on the constitucional coordinases which confer exclusiva authority on the State for dictating basic environmental legislation. The Autonomous Community which today consists of the Territories of Alava, Guipúzcoa and Vizcaya, has authority for the development of legislation and the imposing of basic state legislation, to the extent that the Historical Territories are competent for the development and imposing of the amended regulations of Common Institutions and local bodies according to the attributions which are granted to them by state and/or autonomous community legislation in this subject.
